When did Canada start requiring apostilles?
On May 12, 2023, Canada completed the formalities to join the Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents, better known as the Apostille Convention. This convention simplifies the process of using public documents in foreign countries by substituting the traditional, often lengthy and expensive legalization procedure with a straightforward Apostille certificate.
With Canada's inclusion, the Apostille Convention now encompasses 125 member countries. This event also signifies the 1000th treaty action concerning a Convention or Protocol under the Hague Conference on Private International Law (HCCH). The convention will be operational in Canada starting January 11, 2024.
From this effective date, member countries of the convention are expected to forgo the legalization requirement for public documents originating from Canadian authorities, recognizing instead the apostilles issued by Canada’s appointed competent authority. In a similar vein, Canadian authorities are required to accept apostilles for incoming foreign public documents provided by the authorized bodies of other member countries.
